Version 1.2 · in force from 20 October 2026.

1. Purpose and scope

These rules are established in accordance with articles L6352-3, L6352-4 and R6352-1 et seq. of the French Labour Code.

They apply to anyone attending a training course organised directly by Fenella Rauscher EI (the “training provider”), for the entire duration of the course, whether in person or remotely. In these rules, “participant” means the trainee in vocational training, and “trainer” means Fenella Rauscher or any person she appoints to deliver the training.

Training delivered as a subcontractor. When Fenella Rauscher works as a trainer on behalf of another training provider, that provider remains the participants’ contractual counterpart, unless otherwise agreed. Its own training rules then apply, together with the health and safety rules of the training venue. Each party’s responsibilities (information, discipline, accessibility, complaints, personal data) are set out in the subcontracting agreement and in the documents provided to participants.

Equal treatment and neutrality. The training provider ensures equal treatment of all participants. It ensures respect for freedom of expression and conscience and the neutrality of the teaching provided (French Labour Code, art. L6352-4).

2. Communication of the rules

These rules are given or made available to each participant before final registration and, at the latest, before the training begins. They are also communicated to the employer or funding body where this is useful for preparing the training. They can be consulted at any time on the training provider’s website.

Any new version is communicated before it comes into force.

3. Health and safety

Each participant complies with health and safety instructions, in particular the fire and evacuation instructions of the training venue.

Training on other premises. When the training takes place on the premises of a client company, a partner organisation or another establishment, the health and safety rules of those premises apply to participants in addition to these rules. Where that company or establishment has its own internal rules, the applicable health and safety measures are those of its internal rules (French Labour Code, art. R6352-1).

Remote training. Participants attend the training in conditions that preserve their safety, their concentration and the confidentiality of exchanges. They comply with the rules applicable to the place from which they connect.

Alcohol, drugs, tobacco. It is forbidden to enter the premises or spaces used for the training while intoxicated or under the influence of drugs. It is also forbidden to bring in or consume alcoholic drinks or drugs there, and to smoke or vape there.

Accidents. Any accident or incident occurring during the training is reported immediately to the trainer or to the person responsible for the training venue. Any accident that may qualify as a work accident or commuting accident is also reported without delay by the participant to their employer, in accordance with the applicable procedures.

4. Discipline

Schedule and attendance

Participants keep to the schedule they have been given. They sign an attendance sheet, on paper or electronically, for each half-day. Any absence or late arrival is reported to the trainer as soon as possible. The training provider informs the employer or funding body where this is necessary to monitor the training.

Conduct

Each participant behaves respectfully towards the other participants and the trainer. Any discriminatory, humiliating or sexist remark or behaviour, or any behaviour amounting to harassment, is forbidden. Sexual harassment and moral harassment are also criminal offences under French law (French Criminal Code, art. 222-33 and 222-33-2). Anyone who is a victim or witness may report it to the trainer, who takes the necessary measures.

Digital tools and artificial intelligence

During exercises using digital or artificial intelligence tools, participants do not enter the following, unless expressly authorised by the entity concerned and instructed by the trainer:

  • personal data, in particular sensitive data (health, opinions, etc.);
  • confidential information or information covered by trade secrets;
  • documents, code, login details or passwords belonging to their employer, a client or a third party.

Exercises use fictitious, anonymised or specially prepared data. Participants comply with the tools’ terms of use, as well as with their employer’s security rules and internal policies.

The tools used during the training may be provided by third-party providers. Each participant remains responsible for complying with their organisation’s rules and with the instructions given during the training.

Recording and materials

No participant may record, photograph, capture or broadcast all or part of the training (discussions, shared screen, materials, contributions of other participants) without the prior consent of the trainer and, where applicable, of the persons concerned.

The materials provided are intended for the use foreseen in the context of the training. They may not be reproduced, distributed, resold or made available to third parties without permission. This restriction does not apply to content distributed under an open licence (for example Creative Commons), which may be reused under the terms of the licence indicated.

Remote training

Participants connect using the tools indicated. Keeping the camera on during discussions is recommended, to make participation easier.

5. Disciplinary measures

A disciplinary measure is any measure, other than verbal remarks, taken by the training provider following conduct by a participant considered to be at fault, whether or not that measure immediately affects their attendance or calls into question the continuation of the training (French Labour Code, art. R6352-3).

Depending on the seriousness of the facts, the possible measures are:

  • a written warning;
  • temporary exclusion from the training;
  • permanent exclusion from the training.

Fines and other financial penalties are prohibited.

In accordance with article R6352-8 of the French Labour Code, the training provider informs the employer and, where applicable, the funding body of the measure taken. Only the nature of the measure and the strictly necessary information are transmitted, in compliance with personal data protection rules.

6. Participants’ rights in disciplinary matters

No disciplinary measure may be taken without the participant having first been informed in writing of the complaints against them (French Labour Code, art. R6352-4).

When a measure affecting, immediately or not, the participant’s attendance at the training is being considered (French Labour Code, art. R6352-5 and R6352-6):

  • the participant is summoned by letter delivered by hand against a receipt or by registered letter, stating the purpose of the meeting and its date, time and place;
  • they may be assisted by a person of their choice, in particular a trainee representative if there is one;
  • during the meeting, the reason for the measure being considered is stated and their explanations are heard;
  • the measure may not be taken less than one full day or more than fifteen days after the meeting; it is reasoned and notified in writing, by letter delivered by hand against a receipt or by registered letter.

Interim measure. When conduct makes immediate action essential, the participant may be temporarily excluded as an interim measure, pending the disciplinary procedure. This measure is not, in itself, a disciplinary measure: no final measure relating to that conduct may be taken unless the procedure described above has been followed (French Labour Code, art. R6352-7).

7. Participant representation

When the total duration of a training course exceeds 500 hours, the training provider organises the election of trainee representatives, under the conditions laid down in articles R6352-9 et seq. of the French Labour Code. For courses with a total duration of 500 hours or less, no election is required; participants may submit their observations or complaints directly to the training provider.

8. Accessibility and disability

Anyone with a disability, or facing a particular difficulty in accessing the training, may contact the disability officer before or during the training: Fenella Rauscher, by email, at the address given at the top of these rules.

A confidential discussion makes it possible to identify suitable adjustments: materials, pace, teaching methods, digital tools, reception conditions. No medical diagnosis is requested: only the information useful for the adjustment is collected, with the person’s consent, and deleted at the end of the training. If an adjustment cannot be made directly, the officer may, with the person’s consent, refer them to a competent contact person or organisation.

9. Complaints

Any complaint about a training course may be sent in writing to Fenella Rauscher, by email, using the contact details given at the top of these rules, or by post, to the address given in the training agreement. It is acknowledged and answered within an indicative period of 30 days, depending on the complexity of the request.

When the training is organised on behalf of another training provider, the complaint may also be sent to that provider, using the contact details given in its documents.
